Alleged Fraud: After Five Years, Court Discharges, Acquittes ex-Kogi College Of Education Technical Bursar, Others

Five years after their arraignment for alleged fraud, a Kogi State High Court in Lokoja on Monday discharged and acquitted a former Bursar of Kogi State College of Education Technical, Kabba, Dr Usman Mohammed Momoh and Mr. John Amobeda the college Registrar after the demise of the provost chief Oshadumo.

The judge, Justice E. O. Haruna, said the prosecution’s case lacks merit.

Dr. Usman, Mr Amobeda and late Oshadumo were arraigned in 2018 by the Kogi State Government over a petition accusing them of fraud, conversion of public funds, conspiracy and abuse of office.

The officials were said to have defrauded the college to the tune of N88million.

But giving his judgement on Monday, Justice Haruna said the prosecution did not prove any of the six-count charges against the defendants.

He said the prosecution team called two witnesses but tendered exhibits with no clear and even contradictory evidences before the court.

The judge also said: “For the six-count charges of conspiracy and criminal misappropriation of fund, none of the ingredients of the offences was established by the prosecution.

“Also from the documents tendered, the prosecution has not shown the alleged diversion or misappropriation of money.

“On the whole, the prosecution has failed to prove it’s case as required by law against each of the two defendants. I hereby find each of the defendants (Dr Usman Mohammed Momoh and John Amobeda) not guilty of each of the six-count charges. The defendants are hereby each discharged and acquitted.
